This Privacy Policy applies to functionalformularies.com, Nutritional Medicinals, LLC, and the Functional Formularies / Nutritional Medicinals mobile app, and governs data collection and usage. For the purposes of this Privacy Policy, unless otherwise noted, all references to FUNCTIONAL FORMULARIES include functionalformularies.com and Nutritional Medicinals, LLC. The FUNCTIONAL FORMULARIES website and mobile app are a commerce site and app. By using the FUNCTIONAL FORMULARIES Website and/or Mobile App, you consent to the data practices described in this Privacy Policy.

Collection of your Personal Information

FUNCTIONAL FORMULARIES may collect personally identifiable information, including:

Name and contact data.  FUNCTIONAL FORMULARIES collects your first and last name, email address, postal address, phone number, and other similar contact data.

Credentials.  FUNCTIONAL FORMULARIES collects passwords, password hints, and similar security information used for authentication and account access.

If you purchase FUNCTIONAL FORMULARIES’s products and services, we collect billing and credit card information. This information is used to complete the purchase transaction.

Information about your computer hardware and software may be automatically collected by FUNCTIONAL FORMULARIES. This information can include: your IP address, browser type, domain names, access times and referring website addresses. This information is used for the operation of the service, to maintain quality of the service, and to provide general statistics regarding use of the FUNCTIONAL FORMULARIES Website and/or Mobile App. Please keep in mind that if you directly disclose personally identifiable information or personally sensitive data through FUNCTIONAL FORMULARIES’s public message boards, this information may be collected and used by others. FUNCTIONAL FORMULARIES collects and uses your personal information to operate its Website and/or Mobile App(s) and deliver the services you have requested. FUNCTIONAL FORMULARIES may also use your personally identifiable information to inform you of other products or services available from FUNCTIONAL FORMULARIES and its affiliates. FUNCTIONAL FORMULARIES may also contact you via surveys to conduct research about your opinion of current services or of potential new services that may be offered.

FUNCTIONAL FORMULARIES customers receive regular updates via email as part of their newsletter subscription agreement.

FUNCTIONAL FORMULARIES encourages you to periodically review this Statement to be informed of how FUNCTIONAL FORMULARIES is protecting your information.  FUNCTIONAL FORMULARIES will occasionally update this Privacy Policy to reflect company and customer feedback. If material changes are made to the Privacy Policy, FUNCTIONAL FORMULARIES will provide notice of the changes, and provide you the opportunity to review the changes before they become effective. If you object to any changes, you may cease use of the Website and/or Mobile App, and/or close your account.  Your continued use of the Website and/or Mobile App after FUNCTIONAL FORMULARIES publishes or sends notice of changes to this Privacy Policy means that you are consenting to the updated Privacy Policy.

California Online Privacy Protection Act Notice

  • A Do Not Track (DNT) standard has not been adopted to this day, and therefore Functional Formularies does not use DNT signals.
  • FUNCTIONAL FORMULARIES does not authorize the collection of Personally Identifiable Information (PII) from our users for third party use through advertising technologies without separate user consent.

What is a DNT Signal?

Currently, various browsers (including Internet Explorer, Firefox, and Safari) offer a DNT option that relies on a technology known as a DNT header that sends a signal to Website and/or Mobile Apps visited by the browser user about the user’s DNT preference.  You can usually access your browser’s DNT option in your browser’s preferences.

How does Functional Formularies respond to the signal?

With regard to DNT, FUNCTIONAL FORMULARIES currently does not respond to DNT signals in browsers because no DNT standard has been adopted, as noted above.

YOUR STATE PRIVACY RIGHTS

Certain state laws may also provide you the right to appeal FUNCTIONAL FORMULARIES’ decisions regarding your rights requests if FUNCTIONAL FORMULARIES does not timely respond to your requests or does not take action regarding your requests.  Additionally, if you are a resident of the state of California, you may have a right to pursue legal action for improper handling of your Personal Information.

Submitting a Rights Request

If you wish to exercise the rights listed above, and are a resident of a state that provides such privacy rights, you may submit a request by emailing shop@functionalformularies.com or by calling FUNCTIONAL FORMULARIES at 844-631-8365.  FUNCTIONAL FORMULARIES will provide your Personal Information to you in writing in a readily usable format.  You may also opt-out of the sale of your Personal Information or the use or processing of your Personal Information for profiling or targeted advertising by using this https://www.functionalformularies.com/opt-out-preferences or by emailing shop@functionalformularies.com.  If you choose to submit your request via email, you must include “Privacy Rights Request” in the subject line and clearly provide FUNCTIONAL FORMULARIES with the following information: what type of request you are making, your full name, email address, and valid residential address.  You may only make one request per email. 

FUNCTIONAL FORMULARIES is required to provide you with access to your Personal Information or delete Personal Information only in response to verifiable or authenticated requests.  FUNCTIONAL FORMULARIES will compare the information you provide by telephone or via email with any information FUNCTIONAL FORMULARIES may have in its possession in order to verify your request.  FUNCTIONAL FORMULARIES may also contact you to request additional information in relation to your request.  The information you provide must match the information FUNCTIONAL FORMULARIES has in its possession.  This measure is in place to help ensure that Personal Information is not disclosed to any person who does not have the right to receive it.  The information collected through this process will be used for verification purposes only.  Pursuant to your state’s privacy laws, you may request access to your Personal Information a limited number of times within a 12-month period.

Please note that you may authorize an agent to exercise any of these rights on your behalf by contacting FUNCTIONAL FORMULARIES by email at shop@functionalformularies.com.  If you use an agent, FUNCTIONAL FORMULARIES will take measures to verify your agent’s authorization similar to the verification described above for fulfilling any access or deletion requests.  FUNCTIONAL FORMULARIES may require more information to ensure proper verification of you and your agent’s identity and authorization.

“Do Not Sell” Rights; Sharing for Cross-Context Behavioral Advertising, Profiling, or Targeted Advertising

FUNCTIONAL FORMULARIES may disclose your Personal Information for the following purposes, which are not a sale: (i) for reasons mentioned above; (ii) if you direct us to share Personal Information; (iii) to comply with your requests under applicable law; and (iv) as otherwise required or permitted by applicable law.

FUNCTIONAL FORMULARIES does not sell Personal Information about you for purposes of cross-context behavioral advertising, profiling, or targeted advertising.

Categories of Personal Information Disclosed for a Business Purpose

Sensitive Data of Virginia, Colorado, or Connecticut Residents

If you are a resident of Virginia, Colorado, or Connecticut, FUNCTIONAL FORMULARIES will not process your Sensitive Data (as that term is defined under the Virginia Consumer Data Protection Act; the Colorado Privacy Act; and Connecticut’s Act Concerning Personal Information Privacy and Online Monitoring) without your prior consent.
